OPT / CAP GAP Updates

Interim Rules on Extending Period of OPT by 17 Months for F1 students with STEM degrees and expanding Cap-Gap relief for all F1 students with pending H-1B Petitions:

This ISSO is currently reviewing the regulations. But here are the key aspects of the changes:
  • Only applies to students already on OPT (students apply for 12 months first, and then are able to apply for an extension of OPT for the additional 17 months, provided all conditions are met).
  • Degree must be in a STEM (Science, Technology, Engineering, Mathematics) field as defined by USICE. Please refer to the links below to find out what CIP code your major corresponds to:
  • Must have a job/job offer for the period of extension and the employer must be registered as part of the E-Verify employment verification system (they need to ask their employer if they participate or are willing to participate).
Recent changes require our office to gather employer information for all F-1 students with OPT Authorization. Please complete the OPT Employer Information Form so that we have your most up to date OPT Employer's information on file.
